Het appartementsrecht  moet gesitueerd worden binnen het burgerlijk recht, m.n. in de onderafdeling zakenrecht. Ingevolge dit artikel wordt in de rechtspraak aangenomen dat wanneer de hoofdzaak vervreemd wordt, onlosmakelijk ook de bijzaak vervreemd wordt. Management.
